Online dispute resolution (ODR) in India: Opportunities, challenges, and future prospects

Abstract
Online Dispute Resolution (ODR) is a transformative approach to justice that combines Alternative Dispute Resolution (ADR) methods—like mediation and arbitration—with cutting-edge technology. India's judiciary, grappling with a massive backlog of cases, finds ODR to be a viable solution for improving access to justice. This paper explores the significant opportunities ODR presents, including its ability to provide cost-effective, time-saving, and accessible avenues for resolving disputes, particularly for low-value, high-volume cases in sectors like e-commerce and banking. It also examines the key challenges hindering its widespread adoption, such as the digital divide, lack of public awareness, and the absence of a comprehensive regulatory framework. Finally, the paper discusses the future prospects of ODR in India, focusing on the integration of advanced technologies like AI and blockchain, and the crucial role of government initiatives and legal-tech startups in creating a robust and trusted ecosystem for digital justice.
